Terms and conditions

1. About these terms

These terms apply to your use of the website museumvr.co.uk (the "website") and explain the general basis of our free tour creation and trial offer for museums and heritage organisations. In these terms "MuseumVR", "we", "us" and "our" mean Real View TV Ltd, trading as MuseumVR, and "you" means anyone using the website or enquiring about our services.

Real View TV Ltd is a company registered in England and Wales with company number 16284963. Our registered office is 71-75 Shelton Street, London, WC2H 9JQ, England. You can contact us at [email protected].

2. Using the website

You may use the website to find out about our services and to contact us. You must not misuse it, for example by trying to gain unauthorised access to it, introducing malicious code or using it in any unlawful way. We may change, suspend or withdraw the website at any time.

3. Information on the website

We aim to keep the website accurate and up to date, but it is provided for general information only. Descriptions of our tours, equipment and services are not an offer capable of acceptance. Images show our own VR reconstructions. The Aquae Sulis tour is a demonstration of our work and is not currently offered at any museum or heritage site, and nothing on the website suggests any partnership or endorsement unless we say so expressly.

4. Our free tour and trial offer

We may offer to create a VR tour for a museum or heritage organisation at no cost, and to run it on site for a free trial period, usually one week, with headsets, charging equipment and staff provided by us. Any such offer:

  • is subject to our agreement with you in writing, including the dates, location, number of headsets and staffing;
  • is made at our discretion, and we may decline to offer a tour or trial;
  • does not oblige you to continue after the trial, and you will not be charged for the trial;
  • is not a contract for continuing services. Any continuing arrangement, including charges based on footfall, will only apply once agreed in a separate written agreement signed by both parties.

During a trial, our equipment remains our property and our staff remain under our direction. You agree to provide the space, power and access we agree with you, and to follow reasonable instructions for the safe use of the equipment.

5. Visitor safety

Our staff introduce the headsets, fit them and stay nearby during tours. VR headsets are not suitable for everyone. The headset manufacturer recommends them for ages 10 and over, and people who are prone to motion sickness, seizures or epilepsy, or who are pregnant, elderly or have heart or other medical conditions, should take advice before use. Visitors may stop and remove the headset at any time.

6. Intellectual property

The website, its text and images, and our VR tours and their content belong to us or our licensors. Some 3D models and sounds in our tours are used under Creative Commons and similar licences, and are credited in the tours. You may view and print pages from the website for your own reference. You must not copy, reproduce or redistribute our content for commercial purposes without our written permission. Ownership and licensing of any tour we create for you will be set out in our written agreement with you.

7. Links

Where the website links to other sites, those links are for information only. We have no control over those sites and are not responsible for them.

8. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Subject to that, we are not liable for any loss or damage arising from your use of, or inability to use, the website, or from reliance on its content, whether in contract, tort (including negligence) or otherwise. Our liability in connection with any tour or trial will be as set out in our written agreement with you.

9. Privacy

We use any personal information you give us as described in our privacy policy.

10. Changes to these terms

We may update these terms from time to time. The version on the website when you use it applies. Please check this page occasionally.

11. Law and jurisdiction

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them, except that if you are based in Scotland or Northern Ireland you may also bring proceedings there.
